TERMS OF SERVICE

By purchasing from or contracting services with Tui Johnson, you agree to these terms and conditions.

1. SERVICES OFFERED

We offer graphic design services, custom artwork and illustration commissions, pottery workshops, and print-on-demand apparel featuring original New Zealand-inspired designs.

2. INTELLECTUAL PROPERTY

For all custom design work (graphic design, artwork, illustration), intellectual property rights remain with Tui Johnson until payment is received in full. Upon full payment, agreed usage rights transfer to the client as specified in the project agreement. Any use beyond the agreed scope requires prior written consent.

3. QUOTATIONS & PRICING

  • Quotations are valid for 28 days from the date issued
  • Quotes are based on the specifications provided at the time
  • Changes to project scope, materials, copy, layout, or delivery schedule may require a revised quotation
  • Any additional concepts, revisions, illustrations, or deliverables not outlined in the agreed scope will be quoted separately.
  • Print-on-demand apparel prices are as listed on the website

4. PAYMENT TERMS

For Custom Services (Design, Artwork, Workshops):

  • For Custom Services (Design, Artwork, Workshops):
    – A deposit of 30–50% is required before work commences on projects over $2,000
    – Remaining balance is invoiced at agreed milestones or on completion
    – Final invoices are due by the 20th of the month following the invoice date
  • Payment is accepted via direct credit (bank details provided on invoice) or through the website payment system
  • Overdue accounts may be referred to a collection agency, and you will be liable for any collection fees

For Print-on-Demand Apparel:

  • Payment is required at the time of purchase through our online store

5. PROOFS & APPROVALS

For custom design work, you will receive proofs for approval. Once you approve a proof, we are not liable for errors in the finished work. Please review proofs carefully before approval. Revisions beyond those outlined in the agreed scope may incur additional fees.

6. CANCELLATIONS

If you cancel a custom project after work has commenced, you are responsible for payment for all work completed up to the point of cancellation.

7. FILES & IMAGES

  • You are responsible for retaining copies of any images or files you supply to us
  • We are not responsible for accidental damage to materials you provide
  • Additional fees may apply for translating, editing, or programming customer-supplied files

8. COLOUR MATCHING

We cannot guarantee exact colour matching between:

  • Screen displays and printed products (screens use light; prints use ink/dye)
  • Colour proofs and final production prints

We will use our best efforts to provide a commercially acceptable finished product. If you require specific colours, please notify us in writing with your order.

9. DESIGN POSITIONING & SIZING

For print-on-demand apparel, designs are proportionally adjusted for different garment sizes to ensure optimal appearance. If you have specific size or positioning requirements, please include a note with your order.

10. CREDIT & ATTRIBUTION

For editorial or published use of custom graphic work, we request a credit line acknowledging Tui Johnson as the creator where practicable.

11. ORIGINALITY & LIABILITY

We warrant that all original work created by us is our own and does not infringe on third-party rights. However, we are not liable for how you choose to use the work after delivery. You agree to hold us harmless for any liability arising from your use of our work that may infringe on others' rights.

12. LIMITATION OF LIABILITY

We are not liable for:

  • Indirect or consequential losses arising from errors or delays
  • Compliance with legislation regarding marking, labelling, or packaging (this is your responsibility)
  • Delays or damages caused by industrial disputes, accidents, equipment failure, acts of God, or other events beyond our control
  • Fitness for purpose if the intended use was not communicated to us

13. PRODUCT SUITABILITY

No guarantee is given that products are fit for any purpose not made known to us at the time of ordering.

14. WORKSHOPS

Workshop terms are subject to availability and booking confirmation. Cancellation policies are outlined in our refund policy.
